Elections are a key factor in determining the quality of governance

Elections are a key factor in determining the quality of governance and the success of democracy, as they allow the public to directly choose their leaders. However, disputes over election results are not uncommon. Differences in vote counts between the KPU and candidates can sometimes lead to conflict, which risks undermining the democratic process.

This is where the Constitutional Court (MK) plays a critical role. As the body responsible for resolving election disputes, the MK is tasked with ensuring fair and just elections. Article 10 of Law No. 8 of 2011, which amended Law No. 24 of 2003, grants the Constitutional Court the authority to handle election disputes.

Article 10 also outlines other powers of the Constitutional Court, including reviewing laws against the 1945 Constitution, resolving disputes between state institutions whose authority is granted by the Constitution, dissolving political parties, and ruling on general election disputes. Additionally, the court can issue dissenting opinions to the House of Representatives (DPR) regarding legal violations committed by the President and/or Vice President.
